• Buyer:  natural or legal person who issues an Order.
• Product:  any good to be supplied by the Seller to the Buyer.
• Order:  an electronic document that intervenes as a form of communication between the Seller and the Buyer, through which the Seller agrees to deliver the Products, and the Buyer agrees to receive and pay for these Products.
• Contract:  by concluding the distance sale-purchase contract, the Buyer declares that he expressly accepts the terms and conditions below and undertakes to comply with them.
• Intellectual Property Rights:  all intangible rights such as know-how, copyright, design rights, model rights, patents, trademarks and domain name registrations for any of the above.

The general terms and conditions will apply to all sales of products by GARANTI PREST S.R.L., through the website  www.piatradesign.com  and may be modified unilaterally, at any time.

II. Products

The images and specifications of the products have exemplary value, the purpose being to create an indicative representation of them, the natural stone usually presenting coloristic variations, shade, grain, texture, density. Products made of travertine, marble, limestone, onyx, basalt, quartz can have deviations in thickness and size up to a maximum of +/- 2 mm, and granite products, depending on their thickness, can have deviations in thickness and size up to at maximum +/- 5 mm. Natural stone products may have shards or cracks up to a maximum of 5% of the delivered quantity.

Any natural stone product must be handled and transported with increased care, the Seller proceeding only to replace those products broken or damaged through his fault. Natural stone products must be transported and stored only on the edge / vertical, never placed horizontally, in order to avoid their cracking, breaking, chipping.

III. Creating an account / purchase

In order to launch an online order, the Buyer can fill in the order form (from the “complete the order” section or can create an account. Both in the order form and in the registration form necessary to create the account on the website  www. piatradesign.com some mandatory personal data will be entered. This data will be current, clear and complete and will be updated whenever necessary. GARANTI PREST S.R.L. reserves the right to restrict access to the site or to certain sections of the site if the information provided by the Buyer proves to be false, incomplete, unclear or out of date. Account and password registration involves certain rules. The chosen words must not create confusion, offend any person or group of people, not contain obscene words and not have a racial or sexual connotation. If a Buyer concludes that for various reasons his account access data is no longer secure, he can change it.

Delivery  can be made by courier or through authorized partners (transport companies).

3. Terms and conditions.

If the Seller confirms the order by issuing the proforma invoice, this will imply a complete acceptance of its terms. The moment of concluding the distance contract with the natural or legal person, respectively, is the moment of confirmation of the Order by the Seller. The general terms and conditions of sale will be the basis of the Contract thus concluded.

V. Plati

The prices shown do not include VAT and delivery cost. VAT is added at the time of placing the order on the Seller’s website (www.piatradesign.com).

The delivery of the products will be made with the payment of the afferent costs, the transport cost being mentioned separately on the order / invoice.

Orders are always paid in full, before delivery, payments being considered valid only after collecting the amounts in the Seller’s account.

The goods in stock will be delivered within a maximum of 3 (three) working days from the date of collection of the value of the order in the Seller’s account. For the special parts, which will be debited / processed according to the Buyer’s customized dimensions, the delivery term and their cost will be specified in the proforma invoice.

If the Buyer / his representative is not at the delivery address and / or does not have equipment / personnel for unloading the goods, he will pay the return costs, within maximum 3 (three) days from the issuance of the related invoice. In case of re-delivery, the Buyer will pay, in advance, the related re-delivery cost.

The promotions are valid as long as they are specified on the website www.piatradesign.ro.

VI. Delivery and reception

The goods are received quantitatively and qualitatively when picking them up from the Seller’s warehouse or when unloading them (if the transport is made by the Seller) at the address indicated by the Buyer, he / his representative signing the fiscal invoice and / or the accompanying notice. or any other document of the transport company (ex: CMR), without objections. Any quantitative and qualitative claim subsequent to receipt will be considered late and will not be accepted.

The Seller is not responsible and does not owe compensation of any kind to the Buyer when the products are damaged as a result of any of his actions, during the unloading operations, the unloading being the responsibility of the Buyer. Also, the delivery staff does not have the duty to handle the delivered products. The task of handling the goods from the means of transport to the premises of the building rests with the Buyer. Products are delivered by car that does NOT have an elevator or crane. The delivery interval is 08.00: 17.30 (Monday to Friday).

The buyer has the obligation to specify if the location where the ordered products will be delivered allows the entry and parking of heavy goods vehicles. The access road to the delivery location must be accessible and paved.

ARE YOU COMING. Risks and responsibilities

GARANTI PREST S.R.L. does not offer any guarantee and does not assume responsibility for interruptions, loss of connection or errors in accessing the site www.piatradesign.ro, as well as damage caused by the insecurity of the line and devices on which person connects to the site www.piatradesign.ro.

Unless otherwise agreed by the Seller and the Buyer, the Seller discharges the risks and responsibilities associated with the products, at the time of their delivery to the courier / transport company with which the Seller collaborates or to the Buyer’s representative. The seller will ensure the proper packaging of the products and the transmission of the accompanying documents.

The Seller will affect the delivery of the products on the Romanian territory, being obliged to send them in a door-to-door system to the Buyer.

VIII. Return policy

The buyer can refuse the delivered products if they do not correspond to the specifications mentioned in the order, by filling in the return form. In this case, the Seller assumes the duty to bring the products to conformity.

The returned product must be in the same condition in which it was delivered (including placed in pallets on the edge, never placed horizontally), in the original packaging (crate, pallet, bag, etc.), including the original packaging (eg straps, wrapping and other elements of this kind which thus ensured the proper anchoring without which the products may be damaged during their transport, not being able to be returned later for sale), with all the accessories that accompanied it, as well as the tax invoice and proof of payment in original. Also, the packaging must be intact, undamaged, without traces of blows and with the initial label. Otherwise, the return is not accepted.

The return of the products is made within 14 calendar days from the date of their delivery, the Buyer will bear both the additional costs related to the return and the initial delivery fee (if the latter was granted free of charge, as a discount, upon placement / confirmation command). The return of the products within 14 calendar days can be made only for the products ordered and purchased online.

The refunds are made within a maximum of 30 (thirty) calendar days from the physical reception (quantitative and qualitative) of the products by GARANTI PREST S.R.L., in its warehouse in Bd. ICBratianu, no. 214, Constanta, in the bank account indicated by to the Buyer.

No return accepted:

• Over the term of 14 calendar days from the date of delivery of the products;
• For products that have been executed / have been the subject of a special import operation based on a special / customized order or for special parts cut from slabs or plates (eg countertops, steps, countertops, baseboards, window sills, etc.) ;
• For products showing signs of damage or wear;
• For products that have been used or show traces of adhesive;
• Partially-only for some of the ordered products.
• For products with shards or cracks up to a maximum of 5% of the delivered quantity.

IX. Property transfer

Ownership of the products will be transferred on the date of collection of their price by the Seller.

X. Liability

The Seller cannot be liable for damages of any kind that the Buyer or any third party may suffer as a result of the fulfillment by him of any obligation arising under the order and for damages resulting from the use of the products after delivery and, in particular, for the loss of products.

XI. GUARANTEES

All products sold on the website www.piatradesign.ro benefit from warranty conditions according to the legislation in force and the commercial policies of the producers. In order to benefit from the guarantee, the Buyer must have the fiscal invoice and the proof of payment, in original.

XII. Major force

1. Neither party will be liable for non-performance of its contractual obligations if such non-performance is due to a force majeure event.

In case the force majeure lasts more than 30 (thirty) days, either party has the possibility to unilaterally terminate the contract, without any penalty for it.

XIII. applicable law

Any disputes between the Buyer and GARANTI PREST S.R.L. will be settled amicably (by e-mail or with the person being discussed, by phone); if this is not possible, the disputes will be resolved by the competent courts in Constanta.

Legislation

The terms and conditions of use are subject to Romanian legislation. In case of litigation, an amicable settlement will be tried first, within 30 (thirty) working days from the registration of the complaint at the headquarters of GARANTI PREST S.R.L. In case an agreement cannot be reached within the previously specified term. , the conflict will be resolved by the competent court from the registered office of the site administrator, in accordance with the Romanian laws in force.
